    My husband and I are going to sign up for a Dependent Care FSA to pay for preschool expenses. We both work full-time, but he's a W-2 employee and I'm a freelancer who receives 1099s. Will the fact that I receive 1099s from my clients disqualify us from using the Dependent Care FSA?

    He's signing up through is W2 job, correct? If so, yes.

      Yes, signing up through his W2 job. I didn't think we'd have an issue since we both work, but a friend said she didn't think we'd qualify since I'm a freelancer and I receive 1099s.
